CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Which hold the main points, just so you, the customer, have a more easier Overview. Please do refer to the more detailed TOS below as those WILL apply to your Order!

TERMS OF SERVICE
LAST UPDATE: 17.07.25This contract applies to the artist further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:PAYMENTS
1. The currency accepted is USD and can be paid through PayPal.2. Commissions must be paid either 100% upfront after sketch approval.3. Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.PRODUCT DELIVERY
4. Customer agrees that Product will be delivered digitally via email address provided by the Customer, after the final payment has been received by the Seller.4a. The time it takes to finish your commission varies 1 week - 4 weeks (= 1 month) depending on factors such as health, the complexity of the commissioned piece, other work, and con seasons.5. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.5a. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
6. Customer has the right to three (3) complete revisions in the sketching phase.7. Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolour or fixing a small detail.CURRENCY CONVERSIONS
8. Customer agrees to pay the total amount specified in Euro.REFUND POLICY
9. Customer has right to request a full refund if there's been no progress for two consecutive months, or when Product has not been completed within four months.10. The Customer is not allowed a refund once I started working on the commission.
- If for any reason I am unable to start your commission you will receive a full refund.
- If you cancel your order before I started it, you can get a full refund.
- The kill fee for canceling the commission after work has begun is 50% of the commission's price. The client then receives the work as is.
- If the buyer wishes to cancel the commission after the work has started, the buyer can be issued a refund but agrees to pay the kill fee.
Paypal specific:
- If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
- If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all before mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.PERSONAL AND COMMERCIAL USE
11. The Product received by the Customer is for personal use only. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.12. I, Critterz (the artist/seller):
- I reserve the right to cancel and refund the order at any time for any reason.
- I retain all copyrights over the commissioned artwork.
- I will NOT claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)
- I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
- I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.13. You (the customer/commissioner):
- You may upload the commissioned artwork on any website and social channels.
- You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, making prints for selling, etc.)
- You may NOT alter the commissioned artwork without my (the artist's) consent.
- You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me (the artist) prior to paying for the artwork though.
- You retain the rights to the intellectual property (IP).
- You may NOT use the commissioned artwork for commercial purposes.The Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.The Following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
- Claiming the artwork as your own
- Altering the artwork without my consentCANCELLATIONS
14. Seller reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.15. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.
